A California appeals court revived a wrongful death case over the death of a dairy worker who was struck and killed by a tractor while working at a dairy. The lower court said the defendant “owed no duty of care to the employees because the consultant’s allegedly negligent omissions were not affirmative misfeasance and, therefore, were not acts wrongful in their nature.”
